Annual Update to the Minimum Wage for Federal Contract Workers Under Executive Order 13658

 

On February 9, 2026, the U.S. Department of Labor’s Wage and Hour Division published a Federal Register notice, Minimum Wage for Federal Contracts Covered by Executive Order 13658, Notice of Rate Change in Effect, 91 Fed. Reg. 5783, announcing the annual update to the hourly minimum wage for federal contract workers covered by Executive Order 13658. The rates announced in this notice apply to certain types of federal contracts entered into between January 1, 2015, and January 9, 2022, that were not renewed or extended (pursuant to an exercised option or otherwise) on or after January 30, 2022.

Effective May 11, 2026, the Executive Order 13658 minimum wage to be paid to workers performing work on or in connection with covered contracts increased to $13.65 per hour, while the required minimum cash wage that generally must be paid to tipped employees performing work on or in connection with covered contracts increased to $9.55 per hour. Tipped employees must receive tips amounting to at least the difference between the cash wage paid and the Executive Order minimum wage.
